MOTAWARE MAIL - END USER LICENSE AGREEMENT

This agreement is between you and Motaware LLC ("Motaware", "we", "us") and
covers Motaware Mail for Windows, including its installer, program files,
documentation and any updates we provide (the "Software"). By installing or
using the Software you accept this agreement. If you do not accept it, do not
install or use the Software.
1. FREE OF CHARGE
The Software is free. It needs no license key, and it works with email
accounts from any provider that offers IMAP and SMTP, without a Motaware
account or subscription.
Motaware Mail mailboxes (for example addresses @zorbimail.com or on your
own domain), their storage and the features of the Motaware plans are
services, separate from the Software. They are provided under the Motaware
Terms of Service (https://motaware.com/Home/Terms) and the plan you choose,
not under this agreement.
2. WHAT YOU MAY DO
Motaware grants you a free, non-exclusive, worldwide license to:
a. install and use the Software on any number of computers, at home, at
work, in schools, in businesses and in government;
b. make copies of the unmodified installer published by Motaware and give
them to others, provided you charge nothing for the Software itself and
keep this agreement and the third-party notices with it.
3. WHAT YOU MAY NOT DO
Except as allowed in section 4 or by law, you may not:
a. sell, rent or lease the Software, or bundle it with something you sell
in a way that suggests the Software is part of what is being paid for;
b. distribute a modified installer or modified program files, or present
them as published by Motaware;
c. remove or change the copyright, license or attribution notices;
d. use the Motaware name or logo in a way that suggests Motaware endorses
you or your product;
e. use the Software to send spam, phishing or other mail that breaks the
law or the terms of the mail service you send it through.
4. THIRD-PARTY COMPONENTS
The Software includes open-source components (among them Qt and Qt
WebEngine, which includes Chromium). Each is licensed by its authors under
its own license, listed in THIRD-PARTY-NOTICES.txt, with the license texts
and the list of components in the "licenses" folder next to the program.
Those licenses, not this agreement, govern those components, and nothing
in this agreement limits the rights they give you.
The components under the GNU Lesser General Public License (LGPL) are
installed as separate DLL files. You may replace them with your own
builds, and you may modify the Software for your own use and reverse
engineer it to the extent needed to debug such changes, as the LGPL
allows. Where any Motaware terms of service say otherwise, this section
prevails for the Software.
5. OWNERSHIP
The Software is licensed, not sold. Motaware and its licensors keep all
rights not expressly granted in this agreement, including the copyright in
the Software, and the Motaware name and logo.
6. YOUR MAIL AND YOUR PRIVACY
Your messages, contacts and settings are stored on your computer, in your
Windows user profile. Passwords and sign-in tokens are kept in Windows
Credential Manager. Motaware does not receive your passwords, or the
messages of accounts you have with other providers.
The Software connects only to:
a. the mail servers of the accounts you add (IMAP, SMTP);
b. the sign-in service you choose for an account (for example Microsoft,
Google or Motaware), when you sign in that way; it receives what you
enter on its sign-in page and returns a token, which the Software keeps
on your computer;
c. for a Motaware Mail account, Motaware's mail servers, which handle that
mailbox under the Motaware Privacy Policy
(https://motaware.com/Home/Privacy);
d. Motaware's download server, to check for updates once a day (turn this
off under Settings, "Check for new versions automatically") or when you
choose Check for Updates; the check is an ordinary web request that
carries nothing about you or your mail, and an update is installed
only if you agree;
e. web addresses in a message, only when you choose to show its pictures
from the internet or open one of its links.
Mail the Software reads through Google's or Microsoft's services is used
only to show, search, organise and send your mail in the Software on your
computer; it is not sent to Motaware, sold, or used for advertising. Use
of information received from Google APIs follows the Google API Services
User Data Policy, including its Limited Use requirements.
Accounts with other providers are governed by those providers' own terms
and privacy policies; Motaware is not responsible for their services. You
are responsible for the mail you send and for keeping copies of mail you
cannot afford to lose.
7. NO WARRANTY
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF
ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
MOTAWARE DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR
UNINTERRUPTED, THAT IT WILL WORK WITH ANY PARTICULAR MAIL SERVICE, OR THAT
ANY MESSAGE WILL BE SENT, DELIVERED OR RECEIVED.
8. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, MOTAWARE AND ITS LICENSORS WILL
NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,
EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, MESSAGES, FILES,
PROFITS OR USE, ARISING FROM OR RELATED TO THE SOFTWARE, EVEN IF ADVISED OF
THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE SOFTWARE IS FREE, MOTAWARE'S
TOTAL LIABILITY FOR ANY CLAIM RELATED TO IT IS LIMITED TO US $10.
Some places do not allow these exclusions or limits, so some of them may
not apply to you. This agreement does not take away any rights you have
under consumer protection laws that cannot be waived.
9. TERMINATION
This license ends automatically if you break this agreement. You may end
it at any time by uninstalling the Software. Sections 4 through 10 survive
termination.
10. GENERAL
Motaware may publish a new version of this agreement with a later version
of the Software; the version that comes with a copy of the Software
applies to that copy. If any part of this agreement is held unenforceable,
the rest stays in effect. This is the entire agreement between you and
Motaware about the Software; Motaware Mail mailboxes and the Motaware
plans are covered by the Motaware Terms of Service.
This agreement is governed by the laws of the State of California, USA,
without regard to its conflict-of-law rules. Any dispute arising from it
or from the Software will be brought only in the state or federal courts
located in Los Angeles County, California, and you and Motaware consent
to their jurisdiction. This does not take away any right you have to
bring a claim in the courts where you live under consumer protection laws
that cannot be waived.
